The key talking points of the article are:

  • The Bankruptcy Code and Rules permit the filing of claims by trustees.
  • Filing claims to maximize returns to creditors is consistent with our duties.
  • When the claims are supported by information in the Debtors’ schedules, filing claims is not frivolous.
