Attorney Steven Weiss, will participate in the American Bankruptcy Institute’s 8th Annual Northeast Consumer Forum panel discussion regarding the challenges facing homeowners and creditors in bankruptcy cases. The consumer session panel discussion, titled “Home Sweet… Uh Oh: Owner, Obligors, Options and Obstacles,” will take place on Thursday, July 11, 2013 from 8:30 a.m. to 10:00 a.m. during the 20th Annual Northeast Bankruptcy Conference. The conference and forum are both hosted at the Hyatt Regency Newport Hotel, located in Newport, Rhode Island.
“Both homeowners and creditors face a variety of challenges in bankruptcy cases,” said Attorney Weiss. “The panel discussion is organized to clarify common areas of misconception from both the homeowner and creditor perspectives.”
A panel of experienced attorneys, as well as bankruptcy judges from several states spanning the New England region, will explore the many obstacles that complicate the goal of preserving a debtor’s interest in real estate and maximizing the return for secured creditors, as well as potential options and considerations for those seeking the relief they need. Questions the panel intends to address include:
- What rights do holders have when only one of the obligors files bankruptcy?
- What potential issues await all owners after only one receives a discharge?
- Can a debtor modify a mortgage loan with reaffirming the debt, and if not, what are the considerations for all parties?
Steven Weiss concentrates his practice in the areas of commercial and consumer bankruptcy, reorganization and litigation. He supervises the firm’s bankruptcy, reorganization and workout practice, and represents creditors, debtors, and others in both commercial and consumer bankruptcy cases throughout Massachusetts.
